3. Account Registration and Eligibility

Eligibility

You must be at least 18 years of age to use our Services. By using our Services, you represent and warrant that you meet this age requirement.

Account Security

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your account information remains accurate and up-to-date

4. Acceptable Use

Limited License

• Resale or commercial use of the Services or content
• Distribution, public performance, or public display of content
• Modifying or creating derivative works
• Reverse engineering or decompiling any software

6. Payment and Billing

Fees

Certain aspects of our Services may be provided for a fee. You agree to pay all applicable fees as described on our website or in your service agreement.

Billing

Payment is due upon enrollment or as specified in your agreement. We accept payment via credit card or other approved payment methods. All fees are non-refundable unless otherwise stated in our refund policy or required by law.

Price Changes

We reserve the right to modify our fees at any time. We will provide reasonable notice of any fee changes.

7. Cancellation and Refunds

Enrollment cancellations and refund requests are subject to our cancellation and refund policy, which will be provided at the time of enrollment. Generally:

• Cancellations made at least 14 days before a scheduled training may be eligible for a full refund
• Cancellations made 7-13 days before training may incur a cancellation fee
• Cancellations made less than 7 days before training may forfeit all fees
• No-shows are not eligible for refunds

8. Certifications and Credentials

Upon successful completion of a training program, you may receive a certificate or credential. These certifications:

• Are subject to verification of identity and course completion requirements
• May have expiration dates requiring renewal or continuing education
• Are issued based on your performance and attendance
• Can be revoked if obtained through fraudulent means

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or completely secure. We make no guarantees about the accuracy, reliability, or completeness of any content or information provided through the Services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTOUPSKILLED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your access to or use of or inability to access or use the Services
• Any conduct or content of any third party on the Services
• Unauthorized access, use, or alteration of your content

You agree to indemnify, defend, and hold harmless AutoUpskilled, its officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, or expenses arising from your use of the Services, violation of these Terms, or violation of any rights of another party.

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in court.
